This bill prohibits agencies from creating new occupational licenses through rules or policies unless the legislature provides such authority. Additionally, the bill requires that by July 1, 2026, "all licensure fees shall be established in statute or rule." Finally, the bill establishes "universal occupational and professional licensing practice authority," which ensures individuals holding an occupational license are entitled to perform their jobs without overreaching scope of practice restrictions. Most government licensing entities are overly restrictive and are largely advocated by special interest groups seeking to restrict competition in the marketplace.

Slightly Reducing the State's Overreaching Occupational Licensing Mandates by Eliminating the Requirement that Makeup Artists Obtain a Certification.

This bill eliminates the requirement that required anyone who wished "to practice makeup artistry," to obtain a certification. This required paying a fee and having at least 100 hours of training, education, or experience. The state's draconian Barber and Cosmetology Services Licensing Board - which should be eliminated entirely - represents one of the very worst forms of cronyism and government overreach. This government entity merely exists to restrict competition and enrich cosmetology and barber schools through outrageous occupational licensure requirements for services which present little to no risk to consumers.

Slightly Reducing Cronyism by Reducing the Scope of the Hospital Property Tax Exemption.

GOP Platform Position: Support

This bill slightly restricts the existing property tax exemption for hospitals by excluding "acute care, outreach, satellite, outpatient, ancillary or support facilities." All state and local tax codes should be constructed in a broadly applied manner with as low of rates as possible for everyone. This and other tax cronyism schemes merely dilute the tax base which results in higher taxes on all other individuals and products to make up for the lost revenue. While this tax cronyism should be repealed entirely, this bill is a step in the right direction.

Hiking Health Insurance Premiums by Imposing New Coverage Mandates for Breast Cancer Screening.

This bill requires most health insurance policies offered in the state to cover breast imaging, including an annual supplemental exam for individuals "believed to be at an increased risk of breast cancer." Each and every health insurance mandate prevents an individual from selecting a plan with just basic or customized coverages to fit their specific needs. As a result, health insurers are forced to only offer costly plans loaded with coverages that most individuals do not need. This can result in lower-income or younger individuals choosing to purchase no insurance plan at all due to the high cost.

This bill enacts the "Protecting Campus Free Speech in Higher Education Act," which provides that public colleges and universities may not "abridge the protected expressive activity of any member of the campus community to speak on campus." Finally, these institutions are prohibited from restricting First Amendment-protected speech to "free speech zones," and they may not charge "security fees" based on the content of a student or organization's speech, or that of an invited guest.

Imposing an Excessive New Mandate on Life Insurance Policy Notices.

Existing law already requires a notice be sent via first-class mail "at least fourteen (14) days prior to the effective date of the lapse or termination."

This bill modifies the state's existing data center sales tax exemption, which provides a tax credit for "the purchase or use of eligible server equipment and new data center facilities." The exemption only applies to data centers with at least a $250 million investment and that create at least 30 new jobs. Under the bill, new data centers are limited to receiving the exemption for 7 years. Previously, there was no maximum time period. Businesses that have already received the exemption are not impacted. While this tax cronyism should be repealed entirely, this bill is a step in the right direction.

Strengthening National Security by Prohibiting Illegal Immigrants from Entering the State.

This bill enacts the "Immigration Cooperation and Enforcement Act," which, based on a similar bill enacted in Texas, makes it a state crime for illegal immigrants to enter Idaho from a foreign country outside of an official port of entry. Additionally, the bill requires a mandatory sentence of at least 5 years in prison for any "dangerous crime" committed by someone who was previously deported or is subject to an order of removal. Finally, jails are required to notify the U.S. Department of Homeland Security when foreign nationals are arrested, and localities may not prohibit law enforcement from cooperating with federal immigration authorities.

Combatting Local Government Overreach by Preventing Localities from Mandating Installation of Electric Vehicle Charing Infrastructure in Building Plans.

This bill increases the sentence for DUI vehicular manslaughter if the offender has a previous conviction for DUI. Under the bill, this would carry a mandatory sentence of 5-25 years in prison and/or a fine of up to $20,000. Weakening Property Rights by Providing Electric Utilities Unreasonable New Legal Protections for Sparking Wildfires.

This bill enacts the "Wildfire Standard of Care Act," which provides legal protection for electric utility companies that cause wildfires. Under the bill, public electric utilities are required to, and private electric utilities have the option to, submit a "wildfire mitigation plan" for state approval. If the utility is later sued for damages resulting from a wildfire caused by the utility, the bill provides a "rebuttable presumption that the electric corporation acted without negligence" as long as the utility "reasonably implemented" the mitigation plan. This measure results in higher property insurance costs by no longer holding utilities properly accountable for the damages they cause.
