This bill requires health insurance policies in the state to cover telemedicine, teledentistry, and telehealth services where either the healthcare provider or patient is located outside the state, the same as if both parties are located in the state. This applies to patients who primarily reside in the state and healthcare providers who have a physical office in the state. Each and every health insurance mandate or price control on co-payments prevents an individual or business from selecting a plan with just basic or customized coverages to fit their specific needs. As a result, health insurers are forced to only offer costly plans loaded with coverages that most individuals do not need.

Allowing Utilities that Spark Wildfires to Skirt Liability for All Future Damages

GOP Platform Position: Oppose

This bill allows utility companies to avoid liability for all damages resulting from any wildfire they spark. The liability may be avoided if they merely enact a so-called "wildfire mitigation plan". Such plans may have little impact in preventing a fire, and may be based on Diversity, Equity and Inclusion (DEI) and other politicized frameworks. This measure follows the sparking of the largest wildfire in Texas history, which utility company Xcel Energy took responsibility for, and is estimated to have caused over a billion dollars in damage. The bill will likely result in skyrocketing property insurance premiums as liability is shifted, and the bankruptcy of Texas ranching operations in the event of a future fire. The ILA's Center to Protect Ranchers is a leading voice on this issue and is fighting for policies that support victims and prevent future harms to the ranching industry.

Growing Government Central Planning by Forcing Taxpayers to Subsidize Rural Hospitals.

This bill, the "Rural Health Stabilization and Innovation Act," requires the Health and Human Services Commission to establish the "State Office of Rural Hospital Finance" and "Texas Rural Hospital Officers Academy." The State Office of Rural Hospital Finance is designed to provide technical assistance to rural hospitals and healthcare systems, while the Texas Rural Hospital Officers Academy is designed to contract with colleges and universities to provide professional development and continuing education for rural hospital and healthcare system officers. The bill also requires the commission to establish several grants programs for rural hospitals, rural hospital districts, and rural hospital authorities, including the "financial stabilization grant program," the "emergency hardship grant program," the "innovation grant program," the "rural hospital support grant program." Finally, the bill requires the commission to establish the "Rural Pediatric Mental Health Care Access Program." According to the bill's fiscal note, the bill is estimated to have a negative impact on General Revenue Related Funds of over $48 million over 2 years. The free market - not central planning by government bureaucrats - is the best mechanism to determine the need and distribution of hospitals across the state. Taxpayers in urban areas should not be forced to subsidize the amenities of individuals who choose to locate in rural or other portions of the state where doctors are not as accessible.

Strengthening Government Integrity by Prohibiting Lawmakers who Leave the State to Deny a Quorum from Accepting Political Contributions or Making Political Expenditures.

This bill prohibits state lawmakers from accepting political contributions during an "impeding absence" or making a political expenditure for travel, food, or lodging during such an absence. The bill defines an "impeding absence" as an unexcused absence out-of-state by a lawmaker during a session, designed to impede the legislature. Lawmakers are required to return any political contributions received during such an absence. The bill also applies to specific-purpose committees and legislative caucuses supporting or assisting a lawmaker during such an absence, and includes an exception for contributions up to the daily per diem rate. Violations carry a civil fine of up to $5,000 per contribution accepted. This bill is in response to over 50 members of the House of Representatives who left the state to prevent a quorum in order to block the House from passing congressional redistricting legislation.

Additionally, the bill prohibits such counties from transferring funds appropriated to a sheriff or constable or prohibiting the sheriff or constable from using such funds. Unfortunately, so-called criminal justice "reforms", have led to skyrocketing crime rates and are being advanced across the nation by George Soros and other left-leaning Billionaires through their funding of advocacy organizations on both sides of the political aisle.

Combatting Local Government Overreach by Prohibiting Counties from Requiring Cash Bonds for Pipeline Approval.

Protecting National Security by Prohibiting Investment of State Funds in China and Other U.S. Foreign Adversaries.

This bill prohibits the investment of state funds in securities issued by a "country of concern" or by entities controlled or under the jurisdiction of such countries. Under the bill, a "country of concern" includes China, Iran, North Korea, and Russia, as well as those designated by the Governor. Additionally, state funds may not be invested or deposited in a bank whose principal place of business is in such countries. The bill also requires divestment of state funds from "scrutinized companies," which are companies based in, or controlled by, those countries or citizens of those countries, if the company does not reorganize to no longer be considered a "scrutinized company." This bill is largely targeted towards online providers of clear orthodontic aligners, such as SmileDirectClub. Under the bill, orthodontic devices can't be provided to an individual unless they undergo an in-person examination by a dentist, receive dental x-rays, and are provided a prescription for their usage by a dentist. This measure represents one of the worst examples of cronyism and utilization of government power to stifle competition under the guise of "consumer protection". This protectionism merely enriches orthodontists and dentists and prevents the free market from expanding competition and lowering costs for consumers.

Putting Taxpayers on the Hook for College Through $590 Million in Higher Education Funding Allocations.

This bill increases allocated annual funding for several colleges and universities and adds institutions to the allocations. Under the bill, total allocations are increased from $393.75 million to $590.625 million (50% increase). For example, the allocation for the University of North Texas increases from over $38.4 million to over $65.1 million, and the allocation for Texas Tech University increases from over $51.3 million to over $82.6 million. While it is a necessary role for government to provide quality K-12 education - ideally through school choice - college and university-level education should be funded through user fees (i.e., tuition) by those who wish to pursue their selected career path.

Combatting Human Trafficking by Allowing the Attorney General to Prosecute Cases if Local Prosecutors Refuse.

This bill provides the Attorney General the authority to prosecute human trafficking crimes. Under the bill, a law enforcement agency that submits a report finding probable cause human trafficking to a local prosecutor is also required to submit the report to the Attorney General. If the local prosecutor has not initiated proceedings within 180 days, the Attorney General is required to do so. The bill also requires law enforcement agencies and local prosecutors to provide the Attorney General with all requested information relating to human trafficking investigations. This bill directly combats the human trafficking surge exacerbated by the ongoing border crisis, where lax federal policies under the Biden administration have allowed cartels to exploit vulnerable migrants for forced labor and sex trafficking, leading to Texas ranking second nationally in hotline calls and high incidences tied to illegal crossings.

This bill requires EBT cards used for Temporary Assistance for Needy Families (TANF) and Supplemental Nutrition Assistance Program (SNAP) to include the name and photograph of the recipient on the card. The cards must also include hotline and website to report suspected fraud. The bill contains exceptions for certain individuals, such as those 65 or older, 18 or younger, or who are victims of domestic violence. Finally, the bill requires the Health and Human Services Commission to monitor and report to the legislature on the frequency with which replacement cards are requested. Requiring a photo on EBT cards makes it harder for someone to use another person's card, such as when it is stolen, sold, or shared illegally. Fraud in benefit programs can lead to benefits going to ineligible people or unauthorized transactions, diverting funds from those who truly need help.

Additionally, the bill requires school districts to adopt procedures to notify parents of any change in their child's mental, emotional, or physical health or well-being, and schools may not adopt procedures prohibiting notifying parents or encouraging students to withhold such information from their parents. Protecting the Second Amendment by Prohibiting "Red Flag" Laws.

This bill prohibits the state and local governments from adopting or enforcing an "extreme risk protective order" law, or a "red flag" program, which allows a court to issue an order authorizing a firearm seizure based on an "ex-parte" (one-sided) petition that alleges the firearms owner is a danger to themselves or others, unless specifically authorized by the state legislature. Additionally, the bill provides that federal red flag laws and regulations are not enforceable in the state and the state and local governments may not accept funds to implement or enforce such laws or regulations. The bill makes it a state jail felony to serve or enforce an extreme risk protective order unless authorized by state law. The one-sided petition violates due process under the law (an individual can't provide their defense) and these programs often lack provisions that prevent nefarious individuals from abusing the system to harass or harm law-abiding individuals, thus unduly infringing their Second Amendment protections and leaving them defenseless.

Growing Government by Subsidizing "Mental Health" Higher Education Degrees.

This bill requires the Texas Higher Education Coordinating Board to establish the "Texas Mental Health Profession Pipeline Program" to develop "pipeline programs" for junior college students to transfer to baccalaureate and postbaccalaureate degree programs in certain mental health fields. This includes fields such as psychologists, licensed professional counselors, and licensed marriage and family therapists. The board is to promote the program and encourage institutions to participate. While it is a necessary role for government to provide quality K-12 education - ideally through school choice - it is not the role of government to promote college and university-level education, which should be funded through user fees (i.e., tuition) by those who wish to pursue their selected career path. By channeling taxpayer funds and state mandates into a mental health education pipeline, this bill expands government bureaucracy and program costs at public colleges, inevitably driving up tuition fees for all students to subsidize these initiatives.
